1. Acceptance of these terms

TrailThrottle is operated by SolidDog Technologies LLC (“TrailThrottle,” “we,” “us”). By creating an account or using the service, you agree to these Terms of Service. Our Privacy Policy explains how we collect, use, and disclose information and is provided as notice of those practices. If you do not agree to these Terms, do not use TrailThrottle.

2. Eligibility

You must be 18 years of age or older to use TrailThrottle, and you confirm this when you sign up. TrailThrottle is not directed to and may not be used by anyone under 18.

3. Your account

  • You agree to provide accurate information and to keep it current.
  • You are responsible for keeping your password secure and for all activity under your account.
  • Notify us promptly of any unauthorized use of your account.
  • You may delete your account at any time from your account settings; see the Privacy Policy and Data Retention Policy for what happens to your data.

4. Acceptable use

You agree not to:

  • Post or promote illegal riding locations, trespassing, or access to private land without permission.
  • Post content that is unlawful, harassing, hateful, threatening, or otherwise objectionable.
  • Impersonate others or misrepresent your identity or affiliation.
  • Disrupt, attack, scrape, or attempt to gain unauthorized access to the service or other users’ accounts.
  • Use the service for spam, advertising, or any commercial purpose not expressly permitted.

We may remove content and suspend or terminate accounts that violate these terms.

5. Your content

  • You retain ownership of the content you post (events, comments, profile information).
  • You grant TrailThrottle a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as needed to operate and provide the service to other members.
  • You are responsible for the content you post and represent that you have the right to post it.
  • Remember that event details, including meetup locations and attendee lists, are visible to other signed-in members.

6. Events, rides, and assumption of risk

Riding dirt bikes and off-road motorcycles is inherently dangerous and can result in serious injury or death. You understand and agree that:

  • TrailThrottle is a scheduling and coordination tool only. We do not organize, lead, supervise, inspect, or vet events, riding locations, routes, or other riders.
  • We do not verify the identity, skill, conduct, or qualifications of organizers or participants. Rider skill levels are self-reported.
  • Your participation in any ride or event is entirely at your own risk. You are responsible for your own safety, equipment, riding within your ability, obeying the law, and obtaining any required permission or permits to ride at a given location.
  • Any interaction or meetup with other users is between you and them. We are not a party to and are not responsible for those interactions.

To the fullest extent permitted by law, you assume all risks arising from your use of the service and from any event, ride, or rider you find through it.

7. Moderation and enforcement

  • Users can report events, comments, and accounts.
  • Organizers may moderate discussion on their own events.
  • We (and our admins) may remove content, and suspend or terminate accounts, to enforce these terms or protect the safety of the community. Admin actions override organizer controls where needed for trust and safety.

8. Disclaimer of warranties

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any content or event information is accurate or reliable.

9. Limitation of liability

To the fullest extent permitted by law, SolidDog Technologies LLC and its owners, members, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, death, property damage, or loss arising out of or related to your use of the service or participation in any ride or event, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless SolidDog Technologies LLC from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these terms or the rights of others.

11. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you violate these terms or to protect the service or its users. Sections that by their nature should survive termination (including assumption of risk, disclaimers, limitation of liability, and indemnification) will survive.

12. Changes to these terms

We may update these terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you or ask you to re-accept. Continued use after changes take effect means you accept the updated terms.

13. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Kentucky have exclusive jurisdiction over any dispute arising out of or relating to these terms or the service.
